Hop, Skip and a Jump Contest
1-All ensembles interested in submitting must submit a video of their ensemble performing “Hop, Skip and a Jump” by Shaun Canon and Darren Reid.
2-You do not need to submit a professional video. All video recordings of said performance are permitted.
3-Performance of “Hop, Skip and a Jump” can be in any location, including a practice room or performance hall. Videos of this performance do not need to be from an actual “Live Event”. All filmed performances of this song are admissible.
4-All ensemble sizes are welcome to enter. There is no size limit and each ensemble must have at least 4 (four) members to participate. Videos may include a vocalist, but they are NOT required to do so.
5-All ensembles must be official ensembles of a school. All schools are welcome to enter their ensembles, including private schools, charter schools, and other such institutions.
6-Video length must be at least ONE MINUTE in length and no more than TEN minutes in length.
7-All ensembles may create new arrangements to the song, “Hop, Skip and a Jump” to fit their own ensemble size and instrumentation. Arrangements are open to the interpretation of the arranger, however they see fit.
8-All videos must be tagged with the keyword “HopSkipJumpContest”. (This goes in the section, “Tags” just under the Video Description when in EDIT mode)
9-All videos will be reviewed and judged by Shaun Canon (Emmy Nominee), Jason Scheff (Lead singer of Chicago), and a panel of judges, after Thanksgiving. Winner will be announced in December of 2013.
10-Winner will be featured in Shaun Canon’s new album, on his new single “If Everybody’s Special”. All expenses for recording AND travel for the winning ensemble will be paid for by Shaun Canon’s team. Jason Scheff will accompany Shaun Canon to visit the winning school, and both singers will take the winning ensemble into the studio to record. Winners will have the chance to work directly with Shaun Canon and Jason Scheff as they record this new single!
Hop, Skip and a Jump has been performed by Tadd (So You Think You Can Dance), Louis Van Amstel (Dancing with the Stars) and has been placed on hit TV shows such as Millionaire Matchmaker (Bravo!) and Drop Dead Diva (Lifetime).
By submitting to or watching this contest (collectively, including all content available through the Hop, Skip and a Jump Contest, Shaun Canon’s Website, hereafter referred to as “The Contest”), you signify your agreement to these terms and conditions (the “Terms & Conditions”). If you do not agree to any of these terms, please do not submit to the Contest.
The Contest Website
The Contest is in no way sponsored, endorsed or administered by, or associated with, YouTube. The information you provide will only be used for The Contest and will not be shared with anyone.
You fully release YouTube from any and every liability or responsibility related to The Contest and/or it’s use, promotions, competitions, etc… These Terms & Conditions apply to all entrants of The Contest.
The Contest website may contain links to third party websites that are not owned or controlled by The Contest. The Contest has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites. In addition, The Contest will not and cannot censor or edit the content of any third-party site. By entering The Contest, you expressly relieve The Contest from any and all liability arising from your use of any third-party website.

General Use, Permissions and Restrictions
Upon entering The Contest, you agree to allow The Contest to use your name and any videos, pictures, etc. you submit in promoting The Contest.
You agree not to solicit, for commercial purposes, any entrants of The Contest with respect to their Contest Submissions.
Your Use of Content on the Site
You may access Contest Submissions for your information and personal use solely as intended through the provided functionality of YouTube and The Contest Website.
You shall not copy or download any Contestant Submission.
You shall not copy, use or distribute the original audio recording of “Hop, Skip and a Jump”.
You may access The Contest’s Content, Contestant Submissions and other content only as permitted under this Agreement.
You agree to not engage in the use, copying, or distribution of any of the Content other than expressly permitted herein, including any use, copying, or distribution of Contestant Submissions of third parties obtained through The Contest for any commercial purposes.
You understand that when viewing The Contest submissions, you will be exposed to Contestant Submissions from a variety of sources, and that The Contest is not responsible for the intellectual property rights of or relating to such Contestant Submissions. You further understand and acknowledge that you may be exposed to Contestant Submissions that are offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against The Contest with respect thereto, and agree to indemnify and hold The Contest, its Owners/Operators, affiliates, and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to your use of the site.
In order to enter The Contest, you must upload to YouTube content of your ensemble performing “Hop, Skip and a Jump” (“Contestant Submissions”), and agree to these Terms & Conditions. Once a Contestant Submission is uploaded, the video can be removed if the Contestant Submission is in violation of YouTube’s Terms & Conditions.
You shall be solely responsible for your own Contestant Submissions and the consequences of posting or publishing them. In connection with Contestant Submissions, you affirm, represent, and/or warrant that: you own or have the necessary licenses, rights, consents, and permissions to use and authorize The Contest to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all Contestant Submissions to enable inclusion and use of the Contestant Submissions in the manner contemplated by the Website and these Terms & Conditions.
For clarity, you retain all of your ownership rights in your Contestant Submissions. However, by submitting Contestant Submissions to The Contest, you hereby grant The Contest a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Contestant Submissions in connection with the The Contest (and its successors’ and affiliates’), including without limitation for promoting and redistributing part or all of The Contest (and derivative works thereof) in any media formats and through any media channels. The above licenses granted by you in Contestant Submissions terminate within a commercially reasonable time after you remove or delete your Contestant Submissions from YouTube.
You further agree that you will not, in connection with Contestant Submissions, submit material that is contrary to the following general guidelines, which may be updated from time to time:
- No nudity, pornography or sexually explicit material.
- No vulgarity or explicit lyrics.
- No videos showing animal abuse, drug abuse, or under-age drinking and smoking.
- No videos showing graphic or gratuitous violence.
- Only upload videos that you made or that you are authorized to use. This means you should not use content in your videos that someone else owns the copyright to without necessary authorizations.
- The Contest does not endorse any Contestant Submission, and The Contest expressly disclaims any and all liability in connection with Contestant Submissions.
- The Contest does not permit copyright infringing activities and infringement of intellectual property rights
The Contest reserves the right to decide whether Content or a Contestant Submission is appropriate and complies with these Terms & Conditions for violations other than copyright infringement, such as, but not limited to, pornography or obscene or defamatory material or violation of the user voting rules. The Contest may disqualify such Contestant Submissions from competition for uploading such material in violation of these Terms & Conditions at any time, without prior notice and at its sole discretion.
The Contest song, “Hop, Skip and a Jump” is properly registered and copyrighted. All school ensembles officially have permission to record and film their performance of “Hop, Skip and a Jump”.
Limitation of Liability
In no event shall The Contest, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive or consequential damages whatsoever resulting from any (I) errors, mistakes, or inaccuracies of content, (II) personal injury or property damage of any nature whatsoever, resulting from your submission (III) any interruption or cessation of transmission to or from our website, (IV) any bugs, viruses, Trojan horses, or the like which may be transmitted to or through our website by any third party, and/or (V) any errors or omissions in any contest or for any loss or damage of any kind incurred as a result of your use of any contest posted, emailed, transmitted or otherwise made available via The Contest, whether based on warranty, contract, tort, or any other legal theory, and whether or not the company is advised of the possibility of such damages. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.
You specifically acknowledge that the contest shall not be liable for contestant submissions or the defamatory, offensive or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you.
You agree to defend, indemnify and hold harmless The Contest, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your violation of any term of these Terms & Conditions; (ii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iii) any claim that one of your Contestant Submissions caused damage to a third party. This defense and indemnification obligation will survive these Terms & Conditions and your use of The Contest.
Ability to Accept Terms & Conditions
You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms & Conditions, and to abide by and comply with these Terms & Conditions.
These Terms & Conditions, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by The Contest without restriction.
These Terms & Conditions shall be governed by the internal substantive laws of the State of Utah, without respect to its conflict of laws principles. Any claim or dispute between you and The Contest that arises in whole or in part from your participation in The Contest shall be decided exclusively by a court of competent jurisdiction located in Salt Lake County, Utah. These Terms & Conditions, together with the Privacy Notice and any other legal notices published by The Contest on the Website, shall constitute the entire agreement between you and The Contest. If any provision of these Terms & Conditions is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms & Conditions, which shall remain in full force and effect. No waiver of any term of this these Terms & Conditions shall be deemed a further or continuing waiver of such term or any other term, and The Contest’s failure to assert any right or provision under these Terms & Conditions shall not constitute a waiver of such right or provision. The Contest reserves the right to amend these Terms & Conditions at any time and without notice, and it is your responsibility to review these Terms & Conditions for any changes. Your use of The Contest Website following any amendment of these Terms & Conditions will signify your assent to and acceptance of its revised terms. You and The Contest agree that any cause of action arising out of or related to The Contest must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.
